Attndz Terms of Use

Please read these Terms of Use (“Terms”, “Terms of Use”, “EULA”) carefully before using the Attndz mobile application (the “App”) and the websites (attndz.com, app.attndz.com) collectively called (“Services”) operated by Attndz (“us”, “we”, or “our”).

Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Services. By accessing or using the Services you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Services.

1. USE OF THE APP

Attndz grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes strictly in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you reverse engineer or attempt to extract the source code of the App, unless applicable laws prohibit these restrictions or you have our written permission.

2. USER ACCOUNTS

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Services. You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. SUBSCRIPTIONS AND IN-APP PURCHASES

Some features of the App are available on a subscription basis (“Attndz Premium”). You will be billed in advance on a recurring basis (monthly or yearly), depending on the subscription plan you select.

Auto-Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel auto-renewal at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Managing Subscriptions: You can manage and cancel your subscriptions by going to your account settings on the App Store (iOS) or Google Play Store (Android) after purchase.

Pricing: Subscription prices are displayed in the App before purchase. Prices may vary by region and are subject to change. Any price changes will take effect at the start of the next subscription period following the date of the price change.

Free Trials: We may offer free trial periods for premium features. If you do not cancel before the free trial ends, you will be automatically charged for the subscription plan you selected.

Refunds: Refunds are handled by Apple (for iOS) or Google (for Android) in accordance with their respective refund policies.

4. INTELLECTUAL PROPERTY

The App and its original content, features and functionality are and will remain the exclusive property of Attndz and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Attndz.

5. USER CONTENT

You retain ownership of any data and content you create, upload, or store through the App (such as attendance records, curriculum data, and reports). By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Services to you. We do not claim ownership over your content and will not use it for any purpose other than operating the Services.

6. PROHIBITED USES

You agree not to use the App:

(a) In any way that violates any applicable national or international law or regulation.

(b) To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter” or “spam”.

(d) To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or which may harm Attndz or users of the Services.

7. PRIVACY

Your use of the Services is also governed by our Privacy Policy, which is available at https://attndz.com/privacy-policy.html. Please review our Privacy Policy to understand our practices regarding your personal data.

8. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. ATTNDZ MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ATTNDZ DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

9. LIMITATION OF LIABILITY

IN NO EVENT SHALL ATTNDZ, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

10. TERMINATION

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.

11. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.

13. APPLE-SPECIFIC TERMS

If you are using the App on an Apple device, the following additional terms apply:

(a) These Terms are between you and Attndz, not with Apple Inc. (“Apple”). Attndz, not Apple, is solely responsible for the App and its content.

(b) Apple has no obligation to provide any maintenance or support services for the App.

(c) In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. Apple has no other warranty obligation with respect to the App.

(d) Apple is not responsible for any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.

(e) Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
